1. Introduction

1.1 Access to and use by you of this site is subject to these Terms and Conditions.
1.2 Use of this site constitutes your acceptance of these Terms and Conditions that take effect when you first use this site.
1.3 Please read these Terms and Conditions carefully. By booking on to a course or workshop you are accepting that you agree with these Terms and Conditions.
1.4 CHBP Education reserves the right to change these Terms and Conditions at any time. You are responsible for checking this site to obtain notice of any such changes. Continued use by you of this site following any such changes constitutes your acceptance of these Terms and Conditions as amended by the posted changes.
1.5 If any of these terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or enforceable, it shall be severed and deleted from the clause concerned and the remaining terms and conditions shall survive, remain in full force and effect and continue to be binding and enforceable.
1.6 These Terms and Conditions shall be governed by and construed in accordance with English law and the English courts shall have exclusive jurisdiction for hearing any dispute arising under these Terms and Conditions.
1.7 The failure of CHBP Education to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision.
1.8 The section titles in these Terms and Conditions are for convenience only and have no legal or contractual effect.

 

2. Access to this Site

2.1 Whilst CHBP Education endeavours to ensure that this site is normally available 24 hours a day, CHBP Education will not be liable if for any reason the site is unavailable at any time or for any period. CHBP Education does not guarantee the functions contained in the site will be uninterrupted or error-free, that this site or its server will be free of viruses or other harmful components, or that this website cannot be tampered with by third parties.
2.2 Access to this site may be suspended temporarily or permanently and without notice. CHBP Education may terminate use of the service with or without cause at any time and effective immediately, at our sole discretion. CHBP Education shall not be liable to the user or any third party for termination of service.

 

3. Information and Links on this Site

3.1 Whilst CHBP Education endeavours to ensure that the information on this site is correct, no warranty, express or implied, is given as to its accuracy and we do not accept any liability for error or omission.
3.2 This site may from time to time contain links to third party websites which are controlled and operated by parties other than CHBP Education. CHBP Education is not responsible for the contents of any linked site. Access by you to a linked site is at your own risk. Third parties are responsible for ensuring that materials submitted for inclusion on this site comply with national and foreign law. We cannot guarantee the accuracy or compliance of this material and expressly disclaim any responsibility for error, omission or inaccuracy in the material.
3.3 CHBP Education accepts no liability whatsoever and gives no warranty in relation to any goods or services sold by third parties to you through advertising on this site.
3.4 The inclusion of any link to a third party site or of advertising of third party goods or services on this site does not imply any endorsement by CHBP Education of the linked site or of any advertised goods or services.
3.5 We welcome the reporting of any errors found in our site or information relating to products and services. Please get in touch using the Contact Us form.

 

4. Limitation and Exclusion of CHBP Education Liability

4.1 CHBP Education shall not be liable for any damages (including, without limitation, damages for loss of business or loss of profits) arising in contract, tort or otherwise from the use of or inability to use this site, or any material contained in it, or from any action or decision taken as a result of using this site or any such material.
4.2 Nothing in these Terms and Conditions shall limit CHBP Education’s liability for death or personal injury caused by its negligence. These Terms and Conditions do not affect or prejudice your statutory rights.
4.3 CHBP Education’s entire liability to you in contract, tort (including negligence) or otherwise in relation to this site shall be limited to £1,000.00 for any one incident or series of related incidents.
4.4 Save as expressly set out in these Terms and Conditions all warranties, conditions, undertakings, terms, and obligations implied by statute, common law, usage, course of dealing or otherwise, are excluded to the fullest extent permitted by law.
4.5 Users of any CHBP Education product purchased from CHBP Education or attendees on any CHBP Education course are solely responsible for their own safety.

 

5. Use by you of this Site

5.1 You must use this site in a lawful manner consistent with all applicable laws and regulations.
5.2 You must not use this site or any services on this site:
5.2.1 to send, receive, upload, download, store, use, distribute or publish any material that is offensive, defamatory, obscene, or which breaches of any other person’s intellectual property rights;
5.2.2 to send unsolicited emails or messages or to collect or store personal data about other users of this site without their consent or for any other purpose in breach of the Data Protection Act 1998;

5.2.3 to carry out any activities to obtain lists of users;

5.2.4 to use or transmit through this site any material that contains viruses or use any software designed to interrupt the functionality of any computer software or hardware or this site;

5.2.5 to do anything that imposes an unreasonable load on this site.
5.3 You agree to indemnify CHBP Education and hold CHBP Education harmless against any claims, and reasonable costs or expenses resulting from your use of this site or services on this site in breach of clause 5.
5.4 Use by you of this site in breach of this clause 5 entitles CHBP Education to terminate immediately your access permission to this site.

 

6. Proprietary Rights

6.1 You acknowledge and agree that the entire content, design and the selection and arrangement of the content and material contained in this site, including but not limited to text, software (including applets), music, sound, photographs, graphics, video, page layout, are protected by copyrights, trade marks, service marks, patents, or other proprietary rights and laws. You acknowledge and agree that you are permitted to use this material and information only on the bases expressly set out below and any use such as but not limited to: copying, reproducing, transmitting, distributing, or creating derivative works of such content or information is prohibited without the prior express written authorisation of CHBP Education.
6.2 You acknowledge that the copyright, design right and all other intellectual property rights in any product purchased from CHBP Education and any other documents or items prepared or produced in relation to the CHBP Education belong to us absolutely. The names, images and logos identifying CHBP Education are propriety marks of CHBP Education.
6.3 You are permitted to print and download extracts from this site only on the following bases:
6.3.1 use of documents and related graphics on this site, downloads or creations from this site are for personal non-commercial use only;

6.3.2 any copies of these pages saved to disk or to any other storage medium may only be used for subsequent viewing purposes or to print extracts for personal use;

6.3.3 no documents or related graphics on this site are to be modified in any way;

6.3.4 no part of this site or any resources downloaded or created from the site may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without CHBP Education’s prior written permission.
6.4 The copying, reproducing, transmitting, distributing, or creating of derivative works of the content or information contained in this site or from resources downloaded or created from this site are prohibited without the prior express written authorisation of CHBP Education.
6.5 Any rights not expressly granted in these Terms and Conditions are reserved to CHBP Education.

 

7. Terms of Sale

7.1 Product and Downloadable Resource Terms of Sale – Price and Payment
7.1.1 The price of any products will be as quoted on our site, except in cases of obvious error.
7.1.2 Prices include VAT (where applicable).
7.1.3 It is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced. We will normally verify prices as part of our despatch procedure. Where a product’s correct price is less than our stated price, we will charge the lower amount when despatching the product to you. If a product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before despatch, or reject your order and notify you of such rejection. We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you an Order Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing.
7.1.4 If you are purchasing from outside the United Kingdom you will be charged in your own currency and the banks will perform the currency conversion into pounds sterling.
7.1.5 Confirmation of your payment will be displayed on screen once it has been authorised and accepted.  You will also receive confirmation of the transaction to the email address you have provided.

 

7.2 Delivery

7.2.1 Your order will be fulfilled within 7 days of the date of purchase unless otherwise specified.

7.3 Refunds and Cancellations
7.3.1 Where we are unable to supply the products you have ordered for any reason, we will issue you with a refund within 7 days of your order, by crediting the card with which you paid for your order.
7.3.2 If the goods we deliver to you are not what you ordered or are damaged or defective in any way, please let us know as soon as you can. We will then either (at your request) refund you the amount paid for the goods, or replace the goods you received with goods the ones you ordered.
7.3.3 You are entitled to cancel your order (by letter or email only) within 14 working days of receipt of the goods unless:
7.3.3.1 The goods you have purchased have been personalised for you.
7.3.3.2 You have purchased an online downloadable resource.
7.3.4 If you cancel your order, you are responsible for arranging and paying for the return of the goods to us. We will refund the money you paid for the goods within 30 days of receipt of the returned goods.

7.4 Serviced Items Payment
7.4.1 Course fees, including any additional transfer charges, are due in full prior to the course taking place. Arrangement for payment after the course date must be made prior to the course. Where such arrangements have been agreed all fees must then be paid within 14 days of the course taking place. In the event of late payment we reserve the right to not accept future course bookings and to cancel delegates’ course bookings from your institution. We also reserve the right to charge interest on outstanding invoices at the rate of 2.5% per calendar month.
7.4.2 Other bookings, including but not limited to INSET Days, Consultancy, School Projects, Twilight / CPD Sessions and Workshops will be invoiced 45 days prior to the delivery of the agreed service. All invoices must be paid in full within 14 days of the invoice date unless specific arrangements have been agreed between all parties. In the event of late payment we reserve the right to not accept future bookings and to cancel bookings from your institution. We also reserve the right to charge interest on outstanding invoices at the rate of 2.5% per calendar month.

 

7.5 Cancellation
7.5.1 All cancellations must be received in writing to training@CHBP.org.uk. There will be no charge if you wish to change the details of a delegate on a course.

A cancellation can be made free of charge within the first 14 days of the course booking.

Cancellations made 2 weeks or less prior to the course date will be charged at the full course fee, per person.

If a booking is made within the 2 week period prior to the course, a full course fee will be payable if the delegate wishes to cancel.

Cancellations made after 14 days and up to 2 weeks prior to the course will incur an administration charge of £75 per person.

Any non-attendance is subject to the full cost of the course.

7.6 Transferring Courses
7.6.1 A delegate may transfer from one course to another by requesting such a transfer in writing to training@CHBP.org.uk at least 30 days prior to the original course taking place.

7.7 Changes to Content
7.7.1 CHBP Education’s courses are frequently updated and enhanced and we reserve the right to alter any of the courses’ content without prior notice.  CHBP Education Ltd will make every effort to provide the services as specified, but, if for any reason beyond its control it fails to do so, neither CHBP Education nor its employees shall be liable for any resulting loss or damage.  In such circumstances, delegates will be offered an alternative date or a credit note.

7.8 Authorisation
7.8.1 By submitting a booking to us, by whatever means, you are acknowledging that you have received authorisation for this expenditure from the relevant person at your institution.

7.9 Legal interpretation
7.9.1 The courses and materials provided by CHBP Education cannot be relied upon for legal interpretation.  Neither CHBP Education nor its employees, trainers or consultants can accept responsibility for delegates’ actions, or those of other people reading the course notes or interpreting the training in litigation, or responsibility for any loss incurred as a result of relying on the training or the training notes.

7.10 Cooling Off Period
7.10.1 From the date of making your booking with CHBP Education, whether online, phone or by post, you have 14 days from which to make a cancellation without charge. Thereafter your booking will be bound by our terms and conditions (see above).

 

8. Privacy Policy, Security and Data Protection Policy 

8.1 CHBP Education conforms to the UK Data Protection Act 1998.
8.2 We use the personal information we collect solely to administer your activities on the site.
8.3 When you provide personally identifiable information to CHBP Education, we may use it to provide you with ongoing information about CHBP Education’s products and services. CHBP Education will not rent, sell or lease this personally identifiable information to other companies or individuals. You have a right to access, rectify, modify and delete any data referring to you. In order to exercise this right please contact us immediately.
8.4 We follow strict security procedures in the storage and disclosure of information that you have supplied to us. CHBP Education is committed to protecting and respecting your privacy. We do not sell, trade, or rent your personal information to others. We do not share our mailing lists with any third parties, including advertisers or partners.
8.5 In common with most organisations, we share aggregate information about our users with our governors and other third parties. This information shows user activity as a whole rather than on an individual basis and cannot be used to individually identify you.
8.6 CHBP Education is aware that privacy and security concerns are a major issue for you when purchasing online. CHBP Education takes every effort to ensure the credit card information you transmit to CHBP Education is kept both secure and strictly confidential, but unfortunately the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our website; and transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.
8.7: We do not store credit card details nor do we share customer details with any 3rd parties

 

9. Currency and Export Restrictions

9.1 All orders processed through this site will be conducted using GBP.
9.2 All Training is held in the UK and export restrictions do not apply.
